By accessing and using Joya ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website and mobile application (collectively, the "Platform") operated by Joya Hospitality Private Limited.

2. Description of Services

Joya provides an online platform that enables users ("Guests") to search for and book accommodations offered by hosts ("Hosts"). Our services include:

  • Property search and booking functionality
  • Secure payment processing
  • Customer support services
  • Host-Guest communication tools
  • Review and rating systems

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Age Requirement

You must be at least 18 years old to create an account and use our services.

4. Booking and Reservations

4.1 Booking Process

When you book a property through Joya, you enter into a direct agreement with the Host. Joya acts as a facilitator of this transaction.

4.2 Booking Confirmation

Bookings are subject to Host acceptance. Hosts have 24 hours to accept or decline booking requests. Unconfirmed bookings will automatically expire.

4.3 Property Accuracy

Hosts are responsible for the accuracy of their property listings. Joya does not guarantee the accuracy of listing information.

5. Payment Terms

5.1 Payment Processing

All payments are processed securely through our platform. We accept major credit cards, debit cards, and digital payment methods.

5.2 Service Fees

Joya charges service fees for using the platform. These fees are clearly displayed before booking confirmation.

5.3 Taxes

Guests are responsible for applicable taxes, including GST, which may be added to the total cost.

6. Host Responsibilities

  • Provide accurate property descriptions and photos
  • Maintain property standards and cleanliness
  • Respond to booking requests within 24 hours
  • Provide clear check-in instructions
  • Comply with local laws and regulations
  • Maintain appropriate insurance coverage

7. Guest Responsibilities

  • Treat properties with respect and care
  • Follow house rules and local regulations
  • Report any damages or issues promptly
  • Provide accurate guest count information
  • Complete identity verification when required
  • Leave honest and fair reviews

8. Cancellation Policy

8.1 Guest Cancellations

Cancellation policies vary by property and are set by individual Hosts. Common policies include:

  • Flexible: Free cancellation up to 24 hours before check-in
  • Moderate: Free cancellation up to 5 days before check-in
  • Strict: 50% refund if cancelled 7 days before check-in
8.2 Host Cancellations

Hosts may cancel bookings in extraordinary circumstances. Guests will receive full refunds and assistance finding alternative accommodations.

9. Prohibited Activities

The following activities are strictly prohibited:

  • Using the platform for illegal activities
  • Providing false or misleading information
  • Circumventing platform payment systems
  • Harassing or discriminating against other users
  • Violating intellectual property rights
  • Creating multiple accounts to evade restrictions

10. Limitation of Liability

Joya's liability is limited to the fullest extent permitted by law. We are not responsible for:

  • Actions or omissions of Hosts or Guests
  • Property conditions or safety
  • Third-party services or content
  • Indirect, incidental, or consequential damages

11. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our services, you consent to our privacy practices.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Continued use of the service constitutes acceptance of modified terms.
